References to "SlumberTales," "we," "us," or "our" in these Terms refer to Chen Ben Dror, operating under the SlumberTales brand.

2. Acceptance of Terms

By purchasing or using SlumberTales, you confirm that:

• You are at least 18 years old (or the legal age of majority in your country).
• You have read, understood, and agree to these Terms of Service.
• You have read and accept our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, please do not use the service.

These Terms apply to all users of the SlumberTales website and service, including visitors, purchasers, and subscribers.

3. Products and Services

SlumberTales offers AI-generated, personalized bedtime stories for children, narrated and delivered as downloadable MP3 audio files.

Single Story — $3.99

• One personalized bedtime story generated to your specifications.
• Delivered as a downloadable MP3 file.
• You receive 2 text preview versions to choose from before audio is generated.
• Yours to keep and play forever — no expiry.

Monthly Plan — $10.99/month

• Up to 10 personalized stories per month.
• Personal story library.
• Priority generation.
• Renews automatically each month until cancelled (see Section 6).

Stories are generated using AI language models (Groq / Llama-3) and narrated using Google Text-to-Speech. Each story is uniquely generated in response to your inputs. Because stories are AI-generated, we cannot guarantee they will be identical to any example shown on the website, though we use prompt engineering to ensure consistent quality and structure.

Delivery is immediate — once you complete your inputs, the story is generated and the MP3 is available for download in the same session. No email delivery of story files is currently provided; you download the MP3 directly from the website.

4. Payment and Billing

All payments are processed by Digistore24 GmbH, a licensed payment processor registered in Germany. SlumberTales does not collect, store, or have access to your payment card details at any point.

• The charge on your bank or card statement will appear as performed by Digistore24.com.
• Accepted payment methods depend on Digistore24's available options in your country (typically credit/debit card, PayPal, and others).
• Prices are listed in US dollars (USD) and are inclusive of applicable taxes where required by law.
• By completing a purchase, you agree to Digistore24's Terms and Conditions for Buyers.

For billing questions or disputes related to the payment itself, you may contact Digistore24 directly or contact us and we will assist you.

5. Refund Policy

If you are not satisfied with your purchase for any reason, contact us within 60 days of the purchase date and we will issue a full refund.

• To request a refund, email relaxjustforme@gmail.com with your order number or the email address used at checkout.
• Refunds are processed through Digistore24 and typically appear within 5–10 business days, depending on your bank.
• We do not require you to explain your reason for the refund.
• This refund policy applies to both Single Story purchases and Monthly Plan charges.

This guarantee does not limit any statutory rights you may have under applicable consumer protection law, which may provide additional rights in your country or region.

6. Subscription — Cancellation

The Monthly Plan renews automatically each month until you cancel. There is no lock-in and no cancellation penalty.

• Cancel anytime by emailing relaxjustforme@gmail.com or by managing your subscription directly through your Digistore24 account.
• Access continues until the end of the current paid billing period. You will not be charged again after cancellation.
• If you cancel within 60 days of a charge, you may request a full refund of that charge under our refund policy (Section 5).
• We will send a reminder email before any renewal charge where required by applicable law.

7. AI-Generated Content Disclosure

All stories produced by SlumberTales are generated by artificial intelligence. Specifically:

• Story text is generated by Llama-3.3-70b-versatile, a large language model, via the Groq API.
• Narration audio is synthesized using the Google Cloud Text-to-Speech API. No human narrator is used.

By using SlumberTales, you acknowledge that:

• You are interacting with an AI system and the story output is AI-generated, not written by a human author.
• Your story preference inputs (child's age, topic, character name, etc.) are sent to third-party AI and text-to-speech APIs in order to generate the story. We do not use these inputs to train any AI model.
• AI-generated text may occasionally contain unexpected phrasing, imperfect grammar, or content that does not precisely match your request. We use structured prompts to minimize this, but cannot guarantee perfection in every case.
• Story outputs are not guaranteed to be identical between two users entering the same inputs, as AI generation involves elements of randomness.

8. License and Permitted Use

When you purchase a story, you receive a personal, non-exclusive, non-transferable license to use the story MP3 file.

Permitted uses:

• Playing the story to your own child or children within your household.
• Storing the MP3 on personal devices for personal playback.
• Gifting the story MP3 to one recipient as a personal gift.

Not permitted:

• Reselling, redistributing, or sharing the story file publicly.
• Using stories for commercial purposes — including but not limited to: selling, sublicensing, broadcasting, or incorporating into commercial products.
• Publishing or uploading stories to streaming platforms, social media platforms for monetized content, or any public repository.
• Claiming authorship of AI-generated stories as original creative works for publication or commercial use.
• Using the SlumberTales service or outputs to train, fine-tune, or evaluate any AI model.

9. Disclaimer — Not Professional Advice

Stories may be designed to address topics such as nighttime fears, transitions, or emotional situations, but they are creative entertainment products — not clinical interventions.

If your child is experiencing significant emotional, behavioral, psychological, or developmental difficulties, please consult a qualified healthcare or mental health professional. Do not delay seeking professional advice because of content you read or hear in a SlumberTales story.

SlumberTales makes no medical or clinical claims and accepts no liability for outcomes related to the use of our stories. Results will vary and are not guaranteed.

10. Children's Privacy

SlumberTales is a service used by parents and guardians on behalf of their children. The service is not directed at children and children do not create accounts, purchase, or directly interact with the service.

• Parents provide story preferences (child's age, topic, optional character name or detail) on behalf of their child.
• We do not knowingly collect personal data directly from children under the age of 16.
• Character names or details you optionally enter are used solely to personalize the story and are not stored after the story is generated.

If you believe a child has submitted personal data to our service without parental consent, please contact us at relaxjustforme@gmail.com and we will take immediate steps to delete it.

11. Intellectual Property

The SlumberTales website, brand, logo, design, underlying software, and prompt engineering are the intellectual property of Chen Ben Dror and may not be copied, reproduced, or used without written permission.

Regarding AI-generated story outputs: ownership of AI-generated content is an evolving area of law. To the extent permitted by applicable law, we assign any rights we hold in the generated story text and audio to you, the purchaser, for your personal use as licensed in Section 8. We make no warranty regarding copyright registrability of AI-generated content.

Third-party trademarks referenced in these terms (Digistore24, Groq, Google) belong to their respective owners and are used for informational purposes only.

12. Limitation of Liability

SlumberTales is provided "as is" and "as available." We make no warranties, express or implied, regarding fitness for a particular purpose, uninterrupted availability, or error-free operation.

To the fullest extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the service.
• Our total aggregate liability for any claim related to SlumberTales shall not exceed the amount you paid us in the 30 days preceding the claim.
• We are not responsible for temporary unavailability of our service due to technical issues, maintenance, or third-party provider outages (including Groq, Google Cloud, or Digistore24).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law provisions.

Any dispute arising from these Terms or the use of SlumberTales shall first be attempted to be resolved by contacting us at relaxjustforme@gmail.com. We will make every reasonable effort to resolve disputes promptly and amicably.

If we are unable to resolve a dispute informally, it shall be submitted to the competent courts of Israel. If you are located in the EU, you may also contact your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

EU consumers retain the benefit of mandatory consumer protection provisions applicable in their country of residence, regardless of the governing law clause above.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.

For material changes that affect your rights or our obligations, we will make reasonable efforts to notify existing customers by email (to the address associated with your Digistore24 purchase). Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

We recommend reviewing this page periodically. The most current version is always at /terms on this website.
